The educational rights of each student receiving special education services must be protected under all circumstances. Educational surrogate parents are individuals who make education-related decisions for students under the age of 18 when their parents cannot be identified or located, or the student is a ward of the State. The Bismarck Special Education Department is responsible for recruiting, training, and assigning educational surrogate parents. Educational surrogate parents are not held liable for actions taken on behalf of students in protecting their educational rights, and have no authority or responsibility for the care, maintenance, or financial support of students they represent.
